Terms and condition of saleThese terms and conditions ("Agreement") apply to your purchase of computer systems and/or related Products and/or services and support sold from this site in the United Kingdom, the European Union, and other European countries ("Product") under the Trading Computers brand ("Falcon Systems"). By accepting delivery of the Product, you accept and are bound to the terms and conditions of this Agreement.The products we sell are specifically designed for use by professional traders and those who aspire to be professional traders through the purchase of appropriate professional trading equipment. Trading the financial markets is generally intended to be a profitable enterprise and ultimately a path to comfortable self-employment. Our products are therefore sold as business/commercial products and NOT consumer products. The European Union and United Kingdom Distance Selling Regulations (DSR) do not apply to these products. If you do not accept this interpretation of the law then you must inform us immediately. By accepting your product at time of delivery you irrevocably accept your shipment as a business/commercial product and all aspects of these terms and conditions. We extensively test our products with professional and near-professional trading software. Our equipment is also tested on business software. While we do not test our equipment on consumer software, in most cases it should perform very well. We do not warranty the product for use on non-trading or non-business software. At the same time we do not warranty software produced by other companies. Some software that is not completely tested may work on some computers and not others (like outs). We do not accept responsibility or liability for a single piece of software that does not run properly, UNLESS it is a widely used trading software (such as eSignal). In such cases we accept responsibility that it will work at least as well on our computers as on a new computer produced by a different company.Payment terms are within Falcon Systems sole discretion, and, unless otherwise agreed to by Falcon Systems, payment must be made at the time of purchase. We are not liable for loss of use or loss of data as a result of delivery delays or equipment failure. Title shall pass from Falcon Systems. to you the buyer upon receipt of goods at destination, providing that the goods were not damaged during delivery. You must promptly notify us of goods damaged in delivery and follow the carrier's insurance procedures. We will repair or replace (see "Replacement" below) items damaged in delivery prior to final settlement by the carrier. Third parties designated by the buyer to receive goods do not diminish the transfer of title to the buyer. You are liable for paying for the product under the terms of this agreement regardless of the success or failure of credit card processing or charge reversal by your credit card issuer. The Laws of the State of Wyoming and the United Kingdom shall govern all purchases. Where these laws conflict, the laws of the United Kingdom shall apply to items delivered in the United Kingdom and the laws of Wyoming shall apply to delivery of items in the United States of America. (Note that as of this date there has never been a dispute between Falcon Systems and any other person, business, non-profit, or governmental entity regarding any transaction). Returns PolicyPrior to returning any Product you must obtain approval from us.
Who pays for deliveryYou pay to return the computer to us for a refund.Responsibility for Damage
In the case of Products that are received damaged, and the damage was not caused by delivery, then the damages are the
customer's responsibility (parts and labor). If there is no delivery damage, then the customer is responsible for the as-found condition of the
computer when it arrives at our location. Our intake inspection is the only condition that will be valid in identifying damage. The Product
should be returned in the original packaging to avoid delivery damage. Poorly packaged Product returns are likely to be damaged, and the shipper
may not accept responsibility for the damage. In such cases, the customer is responsible for Product damages (parts and labor).
The shipper must be notified upon delivery, or shortly thereafter, if there is delivery damage to the Product. Alternative Policies
We reserve the right to negotiate alternative terms with individual customers based on individual circumstances.
Such changes in agreements are only by mutual consent and are binding on all parties to the agreement.
Our offices may be closed or may close early from December 23 to December 29. During this period we may not be available
to answer questions or issue RMAs. From time to time, there may be other periods where responses may be delayed 24-48 hours due to workload, staff
training, or other business requirements.
